What is the name of your state (only U.S. law)? CA

We are in middle of divorce. We both filed divorce 8 month ago. We separated in June 2011.

Do I need give her my W2 form? She does not work, my income during Jan - June, is considered income for both of us, right? So we both should pay tax for it, right?

Thanks,

She will never be expected to pay tax on your income.

As of Dec 31, you were still married. That means that you can file as Married, filing jointly or Married, filing separately. Same for her. If one of you meets the requirements for head of household, that might also be another option for that person, but that is far less common.

If you file as separate, you don't need her signature or to show her your W2. If you file jointly, you do. Since she's not working, it will be easy for you to calculate your taxes both ways and decide which way you want to go.

Of course, you will probably be required to give her your W2 during the divorce, anyway, if alimony or child support are being considered.

The term is "Married Filing SEPARATELY" not single. Other than replacing "singly" with "separately" in mistoff's post, the answer is right. "Single" is NOT an option.
