do i seek an attorney for small claims

I was partners with someone in business for 3 months. He had it first but wanted me to be his partner. No written documents. He never split profit or even paid me for that matter. When I finally knew he did'nt intend on paying me, I told him I wanted the money he owed me and he said take me to court. Do I have a leg to stand on? I do have many witnesses.
