What is the name of your state? Wisconsin. I used to work at a electronics co. from April of 97 to June of 2001. While employed there I was physically struck by one of the lead people on 2 seperate occasions. Both times I went to the operations mgr. and reported it, but nothing was done about it. Ultimately about 5 months after the last instance I was laid off due to a supposed slow down in production with the promise of being brought back in 1 month. Needless to say I was never brought back but did recieve unemployment. Do I still have a case for the lead person striking me? Is there a statue of limitations? Do I have any other recourse? Please help.

You could have filed a criminal complaint with the police against the employee who struck you but you have no "case" beyond that. Yes, I'm sure there is a statute of limitations to pursue an assault charge but I don't know what that is. Even if it hasn't yet tolled, I can't imagine the district attorney deciding to pursue charges for a simple assault that happened four or more years ago.

Thanks for the advice Beth3, I would have filed criminal charges but was told that if the matter wasn't dropped both of us would be fired. I needed my job.
