We are hiring a lawyer, and while we are saving up money for the retainer we had a question... Do we have to tell her that we have a lawyer before we go to court? I know the lawyer will have the answer, but I was just wondering if any of you guys knew since its late at night. I know she is obviously going to want to hire one when she knows we have a lawyer, but if we can do this by not telling her for the longest amount possible that would make everything the easiest, considering all she does is live to make my life living hell.
 


I don't see how it would be any of her business. All you are required to do is file everything properly. Whether or not you have a lawyer doing it is your decision. Ultimately, if she retains a lawyer and wishes to settle, you would need to refer them to your lawyer, but until then, it's a moot point.

This is so wonderful to hear. This lady is really psyco. Not to say that all BM's are... just this one. Her most recent tactic is in the other post I posted, about not allowing the kids to come here.

Other then that, she is trying to get it passed with the Judge that my wife not be allowed to go to the school funtions, and such. There is no reason at all other then the fact that the kids love my wife, that she doesnt want her there. This is so Ridiculas, and I am sick of fighting her on my own. Its time for a Lawyer.

Don't know the story here, however, If a lawyer files the papers for you she (who ever 'she' is..lol) will know at the point in which she is served. If she's served you then I guess she will find when the attorney files as the attorney of record before the court date.

Hum.. maybe it just depends are where you are then. I'm not in Co either but when my husband filed for a modification last year his ex retained an attorney and had to file in the court to be retained and shown as the attorney on record. We were sent a paper from the courthouse, signed by the judge stating he'd requested to be counsel and it was granted.

I am in CO

In Colorado lawyers have to file an "Entry of Appearance" with the court. When they file that they are required to send it to the other party.
