What is the name of your state?FL

AM interested in knowing how the court would look at individuals filing suit against individual for money owed to a business rather than hiring attny. We are owed a large sum of $$ from a business purchase when former owner sold a second mortgage before buisness proved itself. He has died and his wife remains but is not inclined to repay debt. Any thoughts?

You don't HAVE to have an attorney, but it would probably be better if you did. Anyone can file a lawsuit Pro Se (no atty), but its not all that easy.

Was his estate probated ?
Debts of the deceased are paid out of the estate. How long ago did he die ? Creditors have the right to make claims on an estate and can even force probate. So, I think you need a lawyer.

I do not know exactly what probate means. He died late last year, 2003. So does your response mean that even if he signed a contract and his wife may not have, we may still be able to get our money back? Thanks for the response!
