What is the name of your state (only U.S. law)? Georgia
I would like all of your options on this. Remember, I won custody in February and mom moved out of state one week later after telling the judge she would not move if I were to get custody. The two lawyers have been going back and fourth with the whole long distance visitation plan and this is what I came up with and she has agreed. Let me know if I need to add or take away from the plain. Thanks, Rob

Parenting Time / Visitation Schedule

A. Should the Parties reside within eighty (80) miles of one another, then and in that event the non-custodial parent shall be entitled to the following minimum parenting time / visitation with the Minor Children:

1. The non-custodial parent shall have the Minor Children on the first, second, and fifth weekend of each month, Mother shall pick up children from school or homework center on Friday (or 3:00 p.m. if school is not in session) and ending at 6:00 p.m. on Sunday.

2. Additionally, the non-custodial parent shall have no less than two days per week with the Minor Children beginning directly after school and concluding at their normal bedtime. If the parties do not agree, the Minor Children shall be returned at 7:00 p.m. If the Parties do not agree on the days, the Mother’s weekdays shall be Tuesday and Thursday.

3. The Parties shall continue to share holiday visitation as set forth in the original settlement agreement incorporated into the Final Judgment and Decree of Divorce.

4. Transportation for visitation shall be accomplished as set forth in the original settlement agreement (meeting for the exchange of the children shall be: The Chevron Gas Station in Homer, Georgia) incorporated into the Final Judgment and Decree of Divorce, with the exception that the Mother shall be responsible for All transportation on weekday visitation.

B. Should the Parties reside greater than eighty (80) miles from one another, then and in that event the non-custodial parent shall be entitled to the following minimum parenting time / visitation with the Minor Children:


1. Summer for calendar year 2009. In 2009, the Mother shall have the Minor Children in the summer beginning at 8:00 a.m. on the 29th of June and returning the Minor Children on a day and time agreed by both parties on or about the 7th day before school begins in the fall. The Parties shall designate a location that is approximately half way between the Party’s respective residences for exchanging the Minor Children in effectuating summer visitation exchanges.


2. Summer after 2009. Beginning in 2010 and continuing thereafter, the Mother shall have the Minor Children in the summer beginning at 8:00 a.m. on the 24th of June and returning the Minor Children on a day and time agreed by both parties on or about the 7th day before school begins in the Fall. The Parties shall designate a location that is approximately half way between the Party’s respective residences for exchanging the Minor Children in effectuating summer visitation exchanges.


3. Christmas. The Parties will split the Christmas break from school each year. In Even-numbered years, the Mother shall have the first half of Christmas break (The day school lets out till 8:00 a.m. on December 27th) and the Father shall have the second half of Christmas break. In Odd-numbered years, the Father shall have the first half of Christmas break (The day school lets out till 8:00 a.m. on December 27th) and the Mother shall have the second half of Christmas break returning the kids by 8:00 a.m. the day before school starts back. The Mother shall be responsible for transporting the Minor Children to/from the Father’s residence for this visitation period.



4. Thanksgiving. In Even-numbered years, the Father shall have the Minor Children for the entire Thanksgiving break from school. In Odd-numbered years, the Mother shall have the entire Thanksgiving break from school. The Mother shall be responsible for transporting the Minor Children to/from the Father’s residence for this visitation period.

5. Spring Break. The Mother shall have the Minor Children every Spring Break, from the time the Minor Children are released from school on Friday until 6:00 p.m. on the Sunday before school resumes. This seems faie. If you came up with it, and she agree to it, then seems to me nothing needs to be added and taken away. Unfortunately parenting plan is a modify as you go situation, IMO

I would add something about phone calls and "virtual" parenting time. Especially if the children will be gone for a long portion of the summer, you might want contact with the children that is enforceable. Obviously, it goes both ways.

How is that 80 miles measured? By how the crow flies or shortest driving distance or longest driving distance?


1. The non-custodial parent shall have the Minor Children on the first, second, and fifth weekend of each month, Mother shall pick up children from school or homework center on Friday (or 3:00 p.m. if school is not in session) and ending at 6:00 p.m. on Sunday.
Mother is the non custodial parent? What determines the first second and fifth weekends. Weekends begin on Fridays correct? How about then "Mother shall have the Minor Children on the first, second and fifrth weekend of each month. Weekends shall be counted according to what Friday of the month it is. Mother shall pick up children from school or homework center on Friday (or 3:00 p.m. if school is not session) and...."

However Mother is picking up on Friday. What about transportation on Sunday? Her time ends at 6:00 pm. But then what? Does she return the children? If so, where to? If not, do you pick them up? From where?

Why are you switching between non-custodial parent and Mother? USE just mother. It makes it simpler. Okay so it concludes at their normal bedtime. What if it is a non-school day or a summer day? Mother is responsible for all transportation on these days correct?

You are contradicting yourself here. Because in the first paragraph mom picks the children up at school.

Summer for only this year IF the parents live more than 80 miles apart? Is she currently living more than 80 miles from you or not?

On or about? Oh that is very open to interpretation.
