If tenant or owner wishes to discontinue relationship at end of one year lease, is 30 day written notice required? I had verbal discussion with owner about continuing my occupancy, then received a letter to P.O. Box two weeks before end of lease notifying me to move out. Feedback? Thank you.

It does not matter verbally what the Landlord says.. what is the verbage on the lease? You need to follow that or the state's law.

In response to the two replies to my post, the lease states "The term hereof shall commence on _____, and continue to _____." There is no mention of "notice" in the lease. The AK Landlord and Tenant Act is dubious in terms of notification of occupancy termination. For a month-to-month agreement, the law requires at least 30 days written notice before the rental due date. For a week-to-week tenancy, there is a 14 day written notice requirement. The law doesn't seem to address the notice and time requirements for longer term agreements.

I think you will find its 60 days for tenants that have been in the unit longer than a year and 30-days for 1 year or less.

My state is AK.


Attorney says that fixed-term leases (occupancy beginning date to end date) do not require notice from LL. Either move out by occupany end date, negotiate a new lease, or pay rent for next month and hope LL accepts it.

I naively assumed that I could stay on. LL wants me out and now I must scramble to comply.

No matter , State Laws trump the lease provisions .
Just because there is a Lack of the Notice Laws in the lease , does not relieve the LL from giving proper notice . It also does not relieve the tenant from giving proper notice.

In any event the LL has to take the tenant to Court to evict .

Are you familair with AK state law, AK Landlord and Tenant Act? It appear ambiguous because it doesn't address one year or other fixed-term leases with regard to time-frames for notice requirements.

If LL evicts me, and prevails it will mar my record, which I do not want.

By the way, lease does not cover notice requirements for termination of tenacy.
