does a employer have to post new job openings?

What is the name of your state? oregon I work for a hospital in the food service department,that covers cafeteria,and kitchen jobs. There were 2 job openings,one was just newly created that was a supervisory position. They did not post the two jobs and only let a few people of thier choice "interview" for these jobs,the rest of us were in the dark about these jobs even being available until they announced the two people who were hired for these jobs. The two people hired for these jobs had only worked there for 1 month and4 years. I trained the one that had been there for 4 years. I am not ill toward the people who got hired,they are nice and hard workers,i am angry that i did not get a chance to at least go through the motions and compete for these positions or have a chance at an interview for them. Is this illegal and if not,is there any action that can be taken at human recourses or anything we can do to vent off our anger lol. I am only 1 of many people furious over this "political" decision and how they went about filling a position without our knowledge of one even available? Can ya help me with advise? Thank you soooo much for your time!

There is no law in any state requiring an employer to post job openings. If you are covered under a union contract, it may require the employer to do so; if not, there is no recourse.

However, does the employer have promotion lists or similar? You're free to ask your supervisor or Human Resources how you can be considered for the next promotion opportunity.

No i dont think the managers there have any type of promotions area,they just usually post all internal job opportunities on the door of one of the supervisors for all to see (with the acception of these last two lol) i will go ask human resources how to be notified or have a chance to get a promotion the next time the opportunity arrises. Maybe human resourses will inform me if the bosses wont lol. Thank you so much for your input on this!

Bottom line (from what you stated) is that when the positions were created they already knew who they wanted to fill them. All the interviews in the world would not have changed that. It may not be "fair", but there's nothing wrong with it. Now you need to look and see what qualities these people had that made the decision makers want these folks over you and adapt to meet their requriements.

I always thought that seniority meant something but i was wrong. The only thing that was going for these people were that they were good workers (like me) and they were threatening to leave because the job wasnt worth sticking around for and they didnt want to loose them. Hence a position created that never before existed. Its ok,i have decided to put my experience on the table and let the c.e.os from other departments know that i am looking. If they dont offer me something worth staying around for another 9 years,i will just transfer and get more money anyhow. Bottom line i guess instead of feeling sorry for myself, i will put my portfolio to use finually and try to get more pay lol. Your right to that all the interviews in the world wouldnt have done anything to help but it may have opened thier eyes to the fact that just because i am a quiet worker doesnt mean i didnt want more experience in other area or to move up in that department. Since they did not give me the chance to prove myself in other areas,ultimately they will lose a good worker to another department that is willing to pay me what i am worth. God that sounds like im tooting my own horn,which is not me,i just know what im capable of bigger and better things and i really wanted to stick with my present employers but i cant because i need more money to get by with two teenage girls to raise..thanks you guys so much for letting me air out my frustration and giving me very good advice! one more thing lol

I do know why i was not looked at for this position but it sounds conceited. My boss, when i told her that i should have not been looked over for this position, said "im sorry carrie but im not sorry also because i would have hated to lose you where your at now" So i feel that because i am very good at what i do for them now,that they would deny me the chance to move forward because i am a valuable asset for them now where i am at and they dont want to replace me there. I can understand but at the same time,i dont think it is fair like you said because i have proved myself,so well that they would rather pass me up than put me in another positon and lose me where i make them the most money. I run a coffee shop that is hosptal owned and was told recently that in the last board meeting they found that per sqaure foot,the coffee shop generated more money than anywhere else in the hospital,probably because of low overhead costs and the fact that sales have went up over 200% since i started there and i was told that i have generated the best crew ever since they have opened. Sounds like im the supervisor allready lol but the sad truth is my boss says i am the senior worker there that everyone turns to and looks up to but i dont get paid but .50 more than a new hire so as much as i cherish the words,they dont pay my bills lol....so these other people didnt have anything over me as far as why they hired them,they didnt want to lose them and they didnt want to lose me where they have me allready....bummer,that is why i must move on to get the pay i need to raise my girls...thanks again so much you guys are so nice to take the time for advice!!!!!
