My father has filed bankruptcy twice that I know of and I noticed in the newspaper listing it stated he and his wife were both unemployed; he has been employed with the state of Arkansas for over 30 years. Is this legal? :confused:

If your father LIED about having an income on his BK papers, he committed FRAUD.. and that is a crime !!

Let me make this simple. The bankruptcy court factors the petitioners 'earning potential' in their decision to grant or deny the bankruptcy. If he tells them he has zero earnings when he really has, that is fraud.

Bankruptcies are public records, anyone can look at any case. The easiest way .. get an account on PACER, then look up his bankruptcy.
