does anyone know how much are attorney fees?

I know every attorney is different but can you guys give me like an estimate on the cost?
My husband has visitation with his daughter that is 9 everyother sunday, but hasnt been able to see her recently because her mother just refusses him to. She just recently file a restraning order against him so now he has to wait for the court date. can we hire a lawyer to represent him for the RO date? or does he just do it on his own? also can we open a case on her for contempt of court for not following the stipulation orders of visitation?

If we do have to hire a attorney is she liable to pay any of these costs?

yes he can represent himself and yes he can file contempt charges against her.

however i don't know if he can file now or when he goes to court.

call the court house and find out.

Unless an NCP is WELL versed in the laws of thier state, they are ALWAYS better off with a lawyer.

I do not think you have to wait.-my state anyway. My husbands ex kept his kids from him 6 months, on a power trip after our marriage. She then served him with papers for sole custody-no visitation, and more child support. We brought it immediatly to his lawyer, (he had already begun talking with the lawyer, and paying the retainer at this time for the lack of visitation.) he had her served for contempt on visitation, asked for more visitation, and contempt for not paying on debt she was awarded in the marriage.

it ended up that his charges were seen in court first, and she lost, he got more visitation, the joint custody was kept, and her child support was not raised but reduced the amount she owes every month until it was paid. her child support?custody petition was left to be heard another day. Our attorney had her attorney agree any future court appearances would be paid by the loser, and her attorny informed the ex, to drop her charges.(they had already gone through the financials that day) and things have been relatively peaceful ever since.

I really doubt things would have went as well for him if he had had no legal counsel.(just having the lawyer supoena her work records was worth every penny)

A lawyer is going to need at least (in most cases) a 1500.00 retainer to begin. find a lawyer who specializes in divorce and family matters, ask around, find one you are comfortable with, go for the hours consultation, see what they can and cannot do for you.

get a lawyer! dont wait, if he wants what is best for his child!

A lawyer is best to have but if you can't afford one you can do the legwork yourself, you can modify orders yourself, and you can get records yourself, etc. Most state laws, child support guidelines and form are available via web now days. For instance look over to the right hand side of this site and you will see a link to State Law Centers, click and follow the links to your site to search for these rules and regulations of your state.

My ex and I have had no legal council for over 4 years now and have managed just fine with out one.

If you can afford get a lawyer if not, research yourself and do it yourself.

In Duval County Florida more cp and ncp represent themselves and have quicker responses on their own as apposed to having a lawyer. That is what we were told. However each court system is different. Also here the min. retainer fee we have found is 5000.00 up to 10,000.00 because of us having children. This is why we represent ourselves.

Go the law library at your local court house and do your research if you can.
