What is the name of your state? Texas
My husband asked me to sign a prenup before we were married in order to protect all that is left of his families land. (380 acres in his and his 2 sisters names) Since then, on three separate occassions, we have had a total of 5 of those acres surveyed, in both of our names (his sisters had to sign giving permission to do so) I am wondering if this shows some kind of intent on his part that would make our prenup null & void? If not, would I legally be entitled to at least part of the 5 acres we had surveyed together? I forgot to mention... we just bought a home last year and put it on part of the five acres - how would that figure in to the equation? (there is an old farmhouse that also sits on said acreage, where we use to live) I know I have alot of questions, but he just loves to hold that darn prenup over my head whenever we get into a dispute! Thanx for listening and i hope you can help answer at least one of my questions.

The prenup is going to stand regarding the land...but not the house. You would be entitled to a share of the equity in the house itself...just not the land. Even if the prenup were to somehow get voided...your husband only has a 1/3 interest in the land...therefore the maximum share you could be entitled to would be 1/6.
