What is the name of your state? Utah.
I am the custodial parent of my 3 year old son. My ex-wife has now had 2 episodes where she has stopped breathing for no apparent cause. The last one was 2 days ago while in the hot tub at her boyfriends house. She lost consiousness, had to have CPR, and was revived by the paramedics on the way to the ER. The doctors at the hospital could find no obvious cause and suggested she make an appointment with a specialist. My question is, can I refuse to let her take my son overnight until she finds out what is causing this and a way to manage it? She lives alone and her boyfriend does not stay the night at her appartment. My son's safety is my only concern. I can't imagine the hell he would go through if this happened to her again and he was the only one there.What is the name of your state?

File for an emergency order suspending visitation until she can discern the cause and nature of her condition...judge may or may not grant it...but you certainly cannot unilaterally decide not send him overnight just cause you have a concern. That would be contempt and if your allegations do not pan out, you'll like your interfering with her parenting time. Filing a motion is your best option.

Have you talked to his mother to see where she's at and if she'd work with you on this?

Would you OBJECT to the bf spending the night (if that is an option mom would agree to), while the child is there, for safety reasons?

Or even another friend of mom's or a member of mom's family. Rather than suggesting that she shouldn't have overnight visitation why not simply ask her to have someone, anyone, else spend the night there too for the sake of the child.

This is what my kids stepmom did. Granted mine was a surgery that only put me out of out of it for one day, but SM came over to help me out.
