I recently won a default judgement of $40,000 in a dog bite case. Two Rotweillers attacked, killed my dog and mauled my hand which then required surgery. Now, how do I collect? The dog owner does not have any assets but he is working. My attorney does not think we can get anything. The dog owner never showed up for depositions or hearings in court. My attorney is not very interested in pursuing this case as he most likely will not recover any fees. What can I do myself to try collect something?

My response:

If your attorney does not wish to pursue your judgment, there are services that buy judgments - - pennies on the dollar, though.

Ask your attorney what his intentions are in the next 30 days. If he won't attempt to collect, then ask him to waive his fees, and turn your original file over to you.
