we live in arkansas. a 4 yr old girl came on our property and was biten by our dog. not an attack, as the girl was petting the dog and too close to his face...in his "space". we have home owner's insurance. what is our liability?

My response:

Arkansas is a "strict liability" State. One bite from your dog places you "on the hook". However, the parents can also be held partially liable, reducing your overall liability, due to their failure to supervise their 4-year-old. But, your insurance will be liable for the majority of the damages.

A youngster, of "tender years", cannot be held to a defense of "trespass" or other "negligence". They are simply too young to understand such concepts, and as a result, are not held to the same concepts as an adult, or even a teenager, might be held.
