In September myself and my boys were driving down a rural road and came to a stop sign. About that time a dog ran from the yard on the corner toward my vehicle. By the time I started into my right hand turn, the dog (a rottweiler) reached the truck and jumped on the passenger side door. I did not stop at that time because I didn't know what the dog would do but I did get the name off the mailbox. I reached home in about 10 minutes, looked at the door, and contacted the owner of the dog. He asked me to come back to his house to look at the truck and he would be outside waiting for me. He looked at the truck and the scratches went all the way to the metal. He told me to get an estimate and drop it by and he would either pay it or turn it into his insurance company. I did - it was $250. He said he would call me in about 2 weeks -- 4 weeks later he called me and said he would pay it but he needed another 2 weeks to come up with the money, I agreed. Two months later I hadn't heard from him and called him, he said he was expecting a check in approximately 2 weeks and he would pay me. One month later I called him again he said he would call me back the next day...that was 2 weeks ago. I am ready to take him to small claims court...can you give me any guidance as to what is required? Any help is appreciated!

You can take him to small claims now, but... I would first go to his house requesting payment one last time. If he says it will take 1-2 weeks to get the money, say that is perfectly okay, but have him sign a small contract saying he intends to pay the amount. When those 1-2 weeks are up, take him to small claims, and you will have a stronger and much easier case instead of he said she said.

Thank you for your thoughts! I'll try it. If he does or doesn't sign and still doesn't pay I'll probably be back for advice on how to file a claim.
