Here's the situation. Im located in Sarasota Fl, where i have a black lab approxametly 1 year old. A roommate of mine has a Boxer/ Pit Bull Mix. The roomate is generally out of town for 3-6 weeks, but when he is home his dog comes over too. His dog stays at one of his friends due to the previos attacks. The dog has had at least 8 owners, and is out of control. The last time my roommate came home with his dog, it attacked my dog severe enouph to have to take him to the emergency vet. This dog has not only attacked dogs but has turned on people as well(three times to be exact). The last time this dog attacked was more severe and dangerous than any other. It lasted about 10 minutes. It took two of my other roommates to stop the attacking dog, they had to beat the dog with a bat to make it stop(the other dog, believe it or not, did not get injured very badly). This was the second time that the dog had to be beeten to make it stop. what are my rights? and can i have the owner of the other dog pay the vet bill?

My response:

Probably, but not the entire bill.

You see, from your post, it appears that you knew of his dog's propensities and allowed the dog to come into the residence. You should have told him, "That dog SHALL NEVER come into this residence ever again." But, it appears that you never said this, despite your previous knowledge.

Therefore, while he doesn't have a right to destroy or damage other peoples' property with his dog, surely you assumed part of the risk when you failed to "lay down the law" concerning his dog.

It will be up to a judge to determine just how much you may recover; i.e., what percentage of your losses.
