Donald, if you have mistakenly used your real name here, you would be smart to start over and pick an anonymous user name. This thread can be deleted for you.

If Donald is NOT your real name, you can add your legal question about debt collections to this thread by using the "reply to thread" feature.

Thanks.

First, did you need help starting a new thread, Donald?

Second, have you been sued by the debt collector that is trying to collect on your car loan? Does the debt collection agency have a judgment against you?

Here are two links with information, the first to the Indiana Government website with information on fair debt collection practices (what a debt collector legally can and can't do) and the second to Indiana Legal Services with information on social security (you can also apply for legal assistance through this link):

You are correct that a debt collector cannot seize your social security payments, with or without a judgment, but there are things you must do to prevent this seizure.

I have not been sued ....but this does show up in credit report
WHO is saying you owe $3100 on the car? WHO has threatened you with garnishment and a freezing of your bank account?

The debt is showing up on your credit report under WHOSE name (e.g., debt collection agency, original lender)?

It's showing up as ..Drivenowautocr. I took car back in may of 2012....have made no payments on it....but credit report says last payment made on oct.2016...says its a closed account

It appears that it is the original lender who is trying to collect on the car loan debt.

If you are a senior citizen with a low income, you should qualify for free legal assistance. Below is the link again that you can use to locate local help. The attorney who assists you should be able to help you handle the debt collector and can assist and advise if you are sued over the debt.

Good luck, Donald.
