What is the name of your state (only U.S. law)? Florida.

I work for a county fire department in Florida where, at the present time, employees are allowed to donate a portion of accrued vacation time to other employees who have used up all of their vacation/sick time due to long-term illness or injury.

The department is changing this provision by giving the firefighter's union, sole control within their discretion, the ability to allocate vacation time to needy employee(s). This will be done through a newly created benevolent fund in which participating members pay a yearly fee and contribute a portion of their accrued vacation time on a bi-weekly basis.

When this fund is implemented, employees who are not members of the fund won't be allowed to receive donated vacation time from any other employee (regardless if the donor employee is a member of the benevolent fund or not). The department also will not allow employees the right to arbitrarily donate any vacation time to another employee unless they are a member of the benevolent fund.

The benevolent fund in voluntary and open to all members however my concern is that under this provision, we will be obligated to contribute money and vacation hours in order to receive a benefit that is currently voluntary.

Is this legal?

It is not illegal and, in fact, is common in such programs. If you don't contribute vacation time to the bank, you cannot request vacation time from the bank. Nothing illegal about that.
