I am a Texas resident. In February, I signed a contract with a donor egg agency, stating, “fees to be paid by recipient couple: “3000.00 for a Texas resident donor, (or $3500.00 for an out-of-state dono), is due and payable to SPCT’s trust account at the time of initial Donor selection meeting.” We chose a Texas resident donor, and the contract was accepted by SPCT, the agency. However, the donor was uncooperative, and as a result, we decided in March not to use her. We just chose a new Texas resident donor, but we were informed on 4/4 that on 3/30 the agency raised the amount paid to Texas donors to $3500, and we reserved our new donor on 4/2. We feel we should not have to pay the increased fee because 1) we signed a contract stating that we only owed $3000 for a Texas resident donor, and 2) the first donor provided by the agency was uncooperative, causing us to lose time by choosing a new donor after the rates went up. We were not informed that the rates had gone up until after we had reserved our new donor. Please advise. THANKS!
