Don't know what to do

My son was at his uncles house over the weekend. He is 15y/o, he took his motorcycle with him. They were riding at his uncles house. His uncle was riding the motorcycle that my son took, and my son was ridiing his uncles 4-wheeler. Well they had a wreck, involving both the motorcycle and 4-wheeler. There were also 3 other kids on the 4-wheeler with my son. The child on the back was my sons uncles step son. Well the boy had major head trauma and didn't make it. My question is: Can my son get in any trouble, since he was driving the 4-wheeler? Even though his uncle on the motorcycle hit the back of the 4-wheeler when they ran into each other.

It depends on many things. Was the uncle the only adult supervising the kids? Did he allow 4 people on the 4-wheeler? Does your son have a permit to ride a motorcycle or any other type of vehicle?

Are the 4-wheeler and the motorcycle insured?

Yes the uncle gave him permission to be on the 4-wheeler. The other adults were either in the house or maybe outside, I don't really know. His uncle lives next door to my sons grandma,which is the uncles mom. No my son doesn't have a permit. I know the motorcycle isn't insured, because we own it. I guess I never really thought about doing that. I'm just really scared. I've had several people telling me different things. I don't know if I should get a lawyer, or what.

You need an attorney, like yesterday. If I'm understanding correctly, your son was the driver of a vehicle that was involved in an accident in which a passenger died.

Yes, you're understanding is correct. And I did get him an attorney. The attorney said he can see that it was an accident, but thought we did the right thing. I am very scared for my son, he doesn't like to talk much about it. We went to get a check up today with his doctor. He advised for me to continue to stay with him as much as possible. He also encouraged him to attend the services on Friday.
We were also contacted by DFS. They told me that someone made a hotline call about the accident. It's seems like it's going to get very bad. Please advise me of any other advise you or anyone may have.

Well Shay-Pari'e, first of all you must not have kids. We aren't the first people to ever let our son operate a motorcycle or anything like that without a permit of some kind. And I know of alot of people that let kids ride together on them. Second, the attorney said we did the right thing by getting him to protect my son. I *CAN* afford insurance I said " I never thougt about getting it". The family (which is my sons family) said it was an accident also. And for another I wasn't reported to DFS, the accident was. This didn't happen on my property. It happened when my son was with his family.

And you wont be the first to be sued for it either.

Well of course he said that he is looking at a hefty fee for the trials that will be forthcomming in this.

It does not matter where it happened, YOU allowed YOUR child to operate a motor vehicle without the proper licenseing. When the childs mother decides to sue for killling her son then come back here and tell us all what a great idea it was to allow your son to drive illegally.

Also what MORON allowed 4 childrent to be on a 4-wheeler that is built for one (maybe two)?
