My husband is having an affair and left the family for 2 weeks. He came back but still sees and talks to her. I want to file for divorce and can support my kids on my own. Will the courts make him pay child support even though I don't want it. I will be moving to another county in California. He will probably not be able to see them anyway since he has no vehicle.

The court will determine if he is able to see the children, whether or not he has a vehicle will make no difference, if he is given visitation rights you must comply with the order or you could lose custody. As for the support, the judge will also decide on that factor. If the judge feels it is in the best interest of the children to be supported by both parents then you will be awarded support. OF course whether or not you enforce the support order will be up to you. But if you are thinking of withholding the children from their father in exchange for no support you should realize that support and visitation are completely sepearate issues, and regardless of whether he is ordered to pay support or not, he will be awarded some sort of visitation.

Another option - even if YOU do not want to receive support from the father. Take the support payment - no matter what the size of it - and put it into an account for the children. You would be amazed what it can add up to. It would be enough to finance their education in the future.

I use to think that I totally hated my ex and wished that I would never had met him. But out of all the stupid things that he has done, he did two really wonderful things. Our two kids.
