Double Parked while waiting for parking space

In Brooklyn New York I was waiting for a car to finish moving out of a parking space so that I can park there. I got a ticket for Double Parking. I went for a hearing and was told by the judge that I can not stop only if the space is already empty. Is that true and does this make sense?

Sure it makes sense.

You could say that the person was just getting in the car, so it would only take a moment.

You could say that the person was walking towards the car, so it would only take a moment.

You could say that the person was walking out of the store, so it would only take a moment.

You could say that the person was about to walk out of the store, so it would only take a moment.

Get the point?

They have to draw the line somewhere. They chose a bright line.

That is true, you can not hover waiting for some one to move from the space.

You were told by the Judge.

Therefore, it is true. It does not have to make sense to you.

It does not have to be true if told by the judge. I would like to appeal the decision.

And I would like a pony. But even though it's Christmas, I don't think I'm getting one. (In fact, I give it the same odds as you overturning the guilty finding on your double parking ticket).

If the other vehicle was blocking your lane of traffic because it was exiting the spot, then I could see your point, but if you weren't blocked in the least, then that means it was still standing in the spot, and was not actually in the process of exiting the space.

I'd like to also point out that you could have gotten a traffic ticket for obstructing traffic, which is two points and a higher fine.
