What is going on with music downloading? Is it really illegal? Can a person be sued for downloading? If it's illegal, then why are the sites that are used for downloading still open (i.e. kaza, winmx)??

My response:

Go to those sites, and look for their "Frequently asked questions" (FAQ) sections. Your answers are most probably there.

Most of these sites are "outlaw" sites; i.e., they're "off shore" and difficult to stop because they keep changing their locations and servers.
