What is the name of your state (only U.S. law)? Illinois
I have been dealing with an illness for about three months now. I have been protected under FMLA during my time out of work. I recently was sent to a specialist who has now seen my twice. This specialist has now completed more FMLA paperwork continuing my time out of work. But, now he is refusing to complete any short-term disability paperwork. He stated that he can justify my time out of work but not the short-term disability.
Some history with the specialist. I have been a patient at the practice for two months. They have seen my twice in the office. But, we have talked over the phone about once a week to see if medications they have put me on are doing any good. At this point, nothing has helped. As of my last conversation with the doctor I was told, "I completed your FMLA paperwork and faxed it in. But I won't complete the STD paperwork because I don't think you need it." He also stated that he would no longer treat me and that I had to see another specialist.
I'm trying to figure this out. I don't see anything that requires a doctor to complete the STD paperwork. But, how can he just say "I don't think you need it" and refuse. He is taking money out of my pocket which is preventing me from paying my bills. I pay for the STD coverage incase I need it. If I qualify for FMLA, shouldn't I qualify for the STD coverage? Do you have any recourse. I don't know what to do. I feel like I've been dumped in the middle of nowhere with nothing to guide me back.
