I'm looking for a point or two of advice on writing a Model Release.
I'm a commercial photographer and will be shooting staged portraits of
visitors at our local street fair.
The local Boy Scouts are sponsoring the "Photo Booth" and our local city
government wants to see the model release before they can approve the
activity.
This is how the Booth will work:
If visitors to the fair make a $5.00 donation to the Boy Scouts they can have a quick "Portrait session" of 3 or 4 shots. The images will be made available for viewing on the internet and orders for prints can be made through the internet.
Now, the city wants to protect the privacy of it's fair visitors and is uneasy about the fact that anyone will be able to order pictures of anyone else.
My sense is that if I draft a release stating that the "photo subjects" are willing photographic subjects, they understand the photos are going to be posted on the internet, that I will be using the photos to promote my business and that they release me, the Boy Scouts and City gov. from any liability, I should be covered.
There will be no personal information posted on line and no logistical way to password protect each "photo subjects" individual images. The photo lab that prints the photos and sends them out will have the following notice online to gain access to the images.
"All photographs in this gallery are subject to copyrights of the professional photographer listed above and are protected by the Copyright Law of the United States (Title 17, United States Code) and by the Berne Convention. Reproduction, storage or transmittal by any means, of any image on this web site, whole or in part, is prohibited without express prior written permission. Prints purchased from this gallery may not be reproduced or scanned for any reason and may only be used for personal display. If you wish to publish or reproduce the materials in any physical or digital form or use them for any commercial purpose, including display or Web page use, you must obtain prior written permission from the photographer listed above.
Do you agree with these terms? Yes No
I don't want the release to be too scary looking just a simple "I understand" what's going on.
