What is the name of your state (only U.S. law)? PA

I was accepted into the ARD program on 2/16. I've already completed community service hours, safe driving classes, CRN Evaluation and Drug and Alcohol Assessment. When I did the A&D assessment they recommended outpatient treatment 1 hour/week. Now, I received my probation papers and they note that no further action is required. It specifically has the box checked that no treatment is needed.

I kind of remember at my safe driving classes that the instructor showed the order in which the recommendations are accepted...meaning one will overrule another. A&D Evaluation suggestion can be overruled by Insurance and then that can be overruled by court. So, basically the court gets the final say. Hopefully that makes some sort of sense, I don't know the exact words to use here.

It seems to me that I can follow my probation instructions and once the license suspension is up, I am really done with any actions and I just wait out the 1 year probation. I'm sure I can call probation and verify this, but basically I don't want to bring attention to it if it is wrong. Anyway, thought I would see what responses I got here first.

i'm going to be honest.

i'd be proactive so at the end of my probabtion period, i'd know for a FACT that it was all over. that's just me. i'd make the call to my PO.

now, you say the outpatient time is recommended, not required. that might be the issue to not do it. as it wasn't your agreement to the judge and the DA.

now, if your PO says to do it, just do it. it's the best way to put this behind you.

Tough call. The only way to know for sure is ask. I have never heard of a p.o. saying you do not need treatment when a professional says 1x a week. Something does not seem quite right. I see your dilemma. You may regret it but maybe bite the bullet on this one and make sure all issues are resolved. The not knowing maybe worse than the probation sanctions. goodluck.
