So I was given a summons for a drug paraphenalia charge, Possession+Sales.

I will tell you the situation and ask the question after that way you have some background information.

There were a few people at my apartment doing arts and crafts and keeping the noise at a quiet level when we get a knock on the door. I said "Hello" and then the door was opened as the police officer chimed up "Orono Police." He proceeded to stand in the entry way of my apartment until I got up and closed the door behind me. Long story short, I got my brother/roommate out of my apartment and we talked to the Police. The officer asked us to go inside and remove the smoking peices he saw in there. Which My brother willingly did...There were three police and there was 5 people in my apartment.
Later the next day my friend told me that he heard someone say come in. Which I didnt hear the night before and still will hold to it that I did not hear anyone giving them permission to come in.

Really All I want to know is: 1) is there anyway I could fight this?
2) What are the laws for First Offender Programs in Maine? Because Really that is the route I would prefer to go; unless I can win this case easy peazy.

in the law, no corpus delicti means no crime and no valid cause of criminal action.

its my understanding, corpus delicti mean no physical evidence of an injured body or damaged property and no evidence of a breach of the peace.
