I experienced a reaction to an antibiotic drug (taken for a sinus infection) that now has me in chronic pain. I have nerve damage in my left arm. My doctor has acknowledged that is a reaction to the drug. My question is:
As long as the drug companies list all the possible side effects in the fine print, does that protect them from being sued?

My doctor will not say if this will heal. If I am looking at permanent pain, I will consider suing the drug company - if the fine print doesn't matter.

I am in Illinois. Can anyone answer my question? The side effects I experienced were described in the fine print (which was not provided by the pharmacy). Does that get them off the hook? Do they have a responsibility for my chronic pain?

I am a legal nurse consultant and would like to help you, but I need some specific info.

What was the name of the drug? Did you take it in pill form, or was it an injection? How long after the drug was taken did you begin to have these side effects? Has your doctor done any test(s) to rule out other possible reasons for your chronic pain?

It is very difficult to sue a drug company, and the fine print is one of the ways they protect themselves.

The drug was Levaquin, an antibiotic. It was in pill form taken daily (500 mg). I had pain in my arms and feet within one to two days. I did not call my doctor and continued to take the 3 week course as prescibed. I was not concerned... until it was one week after the final dose and the pain continued.

The doctor has done lots of blood work to rule out mineral deficiencies, diabetes, etc. I was having heart palpitations, also a side effect,and then went through stess test, echocardiagram, and wore a holter monitor for 24 hours. I also had an EMG which resulted in the diagnosis of demylinating neuropathy. They hope it will heal with time, but will not say for sure. All of the test were normal except for the EMG. My doctor now wants me to see an othopedic doctor to see if cortizone therapy will help - I think she's just grasping for anything now. My doctor agreed to file a med-watch report with the FDA on me.

I have researched Levaquin on the internet and have found MANY other people that have experienced similar and also much worse side effects. Geocities.com/quinolones is a site that has posts by others in the same boat as me. The thing that scares me is that some of them have been suffering with the pain for over a year. There are veiled comments about suing the drug company - but most say there are gag orders once they are settled out of court.

I appreciate any advice you can provide. I plan to seek professional help if I decide to move forward. I just wondered if that fine print was in their favor. One thing, the fine print describes muscle pain and tendon ruptures, but does not specifically address the demylinating neuropathy. Thanks for your help.

If there is a history of problems with this drug such as the ones you mentioned, listing all side effects may not shield this company. You may want to run this one past those attorneys who are representing others injured by this drug; sounds like you've been in touch with some of those (potential or actual) plaintiffs. Get their attorneys name and number and give them a call. If there is a potential or class action going on, these attorneys should be more than interested in talking to you. Best of luck to you.
