Tara from Pa: i was in a lease with my friend from Jan.-May, now i can't live there anymore. my roomate's boyfriend was freeloading off of us, paying no rent, only to help my friend out. they were bringing drugs into the apartment and i had fear for my life. i didn't want to get into trouble, so i moved out. there had been more problems than drugs...the fact her boyfriend was living with us, which broke the lease. i moved back home and talked to the landlord about only paying for the 1 month i lived there. he said noway, but days later called my house and told my mother to keep me out of there, because my apartment would be getting busted by the police. my question now is: Everything that has been going on and caused me to move out, could i in court beable to get out of paying rent from February until May?
thank you!

well you ARE liable for the rent UNTILL he rerents it..but he has to make a good faith effort.

And it is Illegal for him to collect rent from you and a tenant living there.

Since the landlord caled your mother who will be your witness in court to stay out of there... that statement by the LANDLORD would effectively break the lease, since you still could have moved back in after they are kicked out.

I would write that in a letter and send it certifed mail return reciept, that the LL broke the lease by refusing you to move back in. And no further rent will be due after that date, since it was the Landlords decesion and NOT YOURS!
