My husband was arrested for DUI right after midnight on 01/04/2000 in Carrollton, KY. He was, indeed, drunk. He, however, was not driving. He had walked from the bar to his truck, where he decided he'd better sleep it off before driving. At less than 20 degrees outside, he started the truck, left the transmission in Park and snoozed. A state police officer investigated, found him drunk, and arrested him for DUI. The police report does state that he told the officer that he had walked from the bar.

He drives for a living and a DUI would mean no driving job for 3 years, loss of our health insurance, etc.

This is like a sick joke - his being responsible enough to NOT drive while intoxicated and sleep it off in the truck is what actually lead to the DUI charge!

Hire a lawyer! I think the issue here is that the keys were in the ignition. My brother was charged with driving a boat while intoxicated (he was) but he was just standing by the wheel. There was no maritime law in place and his court appointed lawyer got him off with a years probation and he had to pass a drunk driving (auto) class.

Thanks to all who responded. We took the advice of you'all and hired an attorney. The attorney has been to court for him, and has a date set for him to appear in which the DUI charge is supposedly going to be dropped. He may get PI, but can live with that (and, in fact, that is a fair and more appropriate charge).
