FLorida, Maybe better asked of the attornies. I waas in an accident several months ago. Drunk yes, quite drunk. Driving no. I was not hurt to bad my buddy driving ejected form the vehicle in bad shape. I was pinned with being the driver which I did not deny when the police arrived. I just got in the front seat and tried to answer question before the hospital trip. I was to drunk to make any sense and BAC showed .25 by blood draw. I was more worried about mu buddy's health than I was defending myself. I may have inadveratly indicated I was driving and played along. I was asked to turn myself in 2-3 weeks later and charged with felony DUI. I guess my question is if I did indicate I was the driver before I was asked to turned myself in is that admisable as evidence against me, like self incrimination? My buddy was so drunk he doesnt remeber any of it. I was realy asleep half in and half out when this happened. It was my truck so I felt responsible and played along. Where from here? Thanks

???? cops at the scene of an accident/dui are excellent about ID'g the driver & facts, & they don't just go on the word of a person at the scene......

Think of this as an opportunity to resolve your drinking problem (.25, you're messed up).

My opinion: 99.99 sure you'll be convicted. Cops know the position of people in the car prior to impact, based on their injuries, etc. - you SURE you were not driving ?????????

Hmm,That is my prolem. I am sure I was not driving but as I said I was shaken up ptrrry bqad from the crash. Tokk me three weeks to get over the pains etc.

Yes, your admission can be used in the case against you. They will need to prove that you were impaired at the time you were driving the truck. Having asked you specifically that question and you're having answered in the affirmative will be hard to undo now. You have admission and ownership of the vehicle and your friend can't remember anything.
