Can anyone tell me if a penalty or sanction can be imposed under the Constitution if a person's due process rights are violated? That is, if I requested a fair hearing and did not receive a fair hearing due to an error on the part of an adminstriative agency that should have granted a fair hearing to me under constitutional rights, what I can do or what can I claim if I didn't receive one?

A: You must first exhaust all administrative remedies (including appeals) and then, after you get through with the bureaucracy, you appeal it to the court system.
