Michigan.. I had a felony child support warrant. Got pulled over. I was drunk. They got me for dui. Took me to jail in Oakland county. They said they would release me in the morning if Livingston county wouldn't come get me. Livingston county came. Never got a dui ticket or nothing. Went to court for child support. Got sentenced to 10 months prison. Got to prison. Wrote the city about taking care of the dui while I was in prison. They wrote back and said no, ill have to come in to take care of that. So a warrant was issued. Got released from prison. They run a check on you there they let me go from prison. Violated parole. Next city over from the city who issued the warrant parole officer called the city and asked if they wanted me. 'Advise and release' they said. Went to treatment. Got released from treatment. Ran a lean on me there too didn't want me. Got off parole. Ran a lean again. Next city over didn't want me. About a month later got pulled over driving. Next city over from the warrant issuing city. 'Advise and release' they say again. I guess my question is 1 can they hit me with dui 2nd? My first was when I was 17. I'm now 35. And 2. Can't I get it dropped? They have had MANY opportunities to come get me. I've bettered my life now. I moved away, had a child, made a good life for myself my son and my wife. Can they even still charge me? And if so, a dui 2nd?

You need a lawyer. The DUI isn't going away just because you were locked up for something else in the interim.

As for it being the second offense, there's no "look back" time limit in your state, but if you were under 18 your lawyer certainly can try to make a claim that this shouldn't be counted as a second fofense.
