What is the name of your state (only U.S. law)?
Earlier this week I and another Navy Reservist were on Active Duty orders. Tuesday night both of us and an Active Duty member (all of us Navy law enforcement) were off base at my place of lodging. We started drinking and the other reservist and I had shots and a few beers. The active duty member had only a few beers. Later that night the active duty member decided to go pick up a friend and both I and the other reservist repeatably asked if he was fine to drive. He seemed completely fine and the alcohol was consumed for little over a period of about 3 hours we figured he was good to go. So we decided to ride with him and not long after we pulled out we got pulled over for speeding. The WV State Trooper administered a breathalyser to the driver which he failed, but then proceeded to give him a field sobriety test which he passed. He was then arrested for a DUI and Dispatch was notified and the watch commander and command duty officer came to pick up the vehicle and drove us pass our place of lodging and questioned us back at base and then had us write written statements. A DOD stated that after the field sobriety test that if the driver was not speeding he would have been fine. I repeatedly asked if anything was brought against us to which they replied "nothing is being brought against you." The next day we were told to leave base and go home. We have yet to hear of anything. I learned today that the driver was an E-1, I am a E-3 and the other passenger is a E-4. We know come next drill weekend this will be address as stated by our chief, but we have been left in the dark so far. What could we be facing from the Navy? I already know that given our occupation we made a very bad call. I just don't know what can come of this.
