i got my first dui december 2012, i have no prior dui's and i have never been arrested for any drug or alcohol related crimes. At my assessment I passed the computer test and answered honestly, I rarely drink. the guy doing the evaluation says that i am a high risk, and I asked him why and he said that he does not believe that i rarely drink, is this against the law? when i dont have anything on my record but this dui and I blew a .10

does the judge take into consideration the high risk assessment when handing out his judgment. I have been told that court supervision happens for most first time offenders, will this result in a conviction?

First-time uncomplicated DUI's get routine penalties. Your high-risk assessment will likely put you into a lengthier DUI class. Your "assessment officer" was just checking off boxes on his computer screen. If you answered honestly, then you may in fact have an alcohol problem, and should have it addressed independent of the DUI.

Is what against the law? The examiners opinion? Unprofessional maybe but not illegal.

This is just a case of a guy covering his butt. If he just says that you have a problem and need help for your drinking than he can never be wrong . goodluck.
