What is a "diversion?" How do I find out who the prosecutor is going to be in my case? Will they notify me? Do I just show up on the date given on my ticket? THANKS SO MUCH BINI

Just show up to court on the date shown
I looked up the california statute on drunk driving and could not find anything about diversion on it (California might not have it)
When you go to court just tell the judge that you would like to talk to the prosecuting attorney (he should let you). Ask them if there is diversion in your state,
(Diversion is away the states can still punish you, but you will keep it off of your record after you complete the course)
If you are going to plead guilty, you don't need an attorney especially if this is your 1st d.u.i. just talk to the prosecutor when you go to court.
If the judge will not let you talk to the prosecutor ask the judge before you plea if the court offers a diversion program, if it does tell them that you are interested in it.
(diversion is an automatic plea of guilt). If the judge says there is no diversion program just plea guilty or not guilty. (you might want to read the law)

if you want to read the law go to the main page of this forum and click on state law center, then click on state statutes, then click on your state, then click on statutes, at the bottom of the screen it will say search by keyword, (type in drunk driving) a list of laws will come up, one of them will say (Bill number SB 1186 chaptered 07/06/98) (on my computer it was the 1st one on the list) Click on this.
Trust me it is very very very very very very long

Please reply, to do this go to the bottom of this page and click on reply, that way it will be in this thread and I will see it, if not then make your subject "to Bini"

I hope this helps, and I do hope California does offer diversion like Kansas does, please be sure to read the law

GOOD LUCK TO YOU!

PS. Let me know what happens please!

Thanks so much for all your help, the court date is in February, and with your advice coupled with some other investigating, my stupidity (DUI) will not cost me attorney fees on top of all the other fees imposed by everyone else.
I will let you know what happens!
