Hello. I was 18 and drinking when i shouldn't have been.

I was driving around my little 50. It's really a 49cc mini dirt bike. I was driving this around a state offroad park. It's a big desert. A ranger pulled me over and gave me a citation for...
-DUI
-DUI over .08

This is my first offense, but i do not really think i should have gotten that because of how small the bike was that i was driving. iT goes like 25 mph.

What should I do?

Yes. DUI per sections CVC 23152(a) and CVC 23152(b) are applicable anywhere in the state. You were DUI, and under the statute you were properly charged.

And a 49cc mini-bike is a "motor driven cycle" per CVC 405 and is thus considered the same as a motorcycle ... hence, the normal DUI laws apply.

Consult an attorney.

Learn to tell the truth. I have a small Honda 50 bike for my grandkids and even with my big butt on it, I can come close to pegging the 60 mph speedometer on it. It takes a bit to get there but it can be done.

I can't find them at the moment, but there are cases out there upholding DUI's for people on tractors, horses and bicycles. A dirt bike, albeit 50cc, is more than enough to qualify.

OOPS!!! :eek:
The ranger forgot to charge you with underage drinking, no matter thay can add that later :D They could have cited you for that if you were walking!
You do understand you will lose your driver's license and will cost you a lot of money and will eventually raise your insurance rates and even affect your future employment?
Was it worth it?
