My husband got a DUI in Dawson County Georgia Saturday evening. He was a mile from our house. He said that he only had 3 Beers at home and he was going to pick up some Supper and bring it home. He blew a .10 twice at the arrest site and again at the station. His bail was $1200.00. ( Which seems excessive, but what do I know). He has never been arrested for anything nor has he had any traffic violations. He is 52 years old. He did not come to a complete stop at the stop sign and that is why the officer stopped him. So of course he got a ticket for that also. Can someone tell me what this will cost us and what will be his consequences.

That bail isn't that terrible, mine was $660 for an underage consumption...I drank 4 beers the night I was arrested and blew a 0.04 keep in mind I'm a 140lb 18 year old, 3 beers doesn't make you blow a 0.10, there's pieces of the puzzle missing.

There are two types of punishment for DUIs, criminal and administrative.

If the officer filled out a DPS 1205, the state will try to suspend your husband's license to drive for one year. If he doesn't respond within 10 days of arrest, then on the 30th day after the arrest, his suspension will be in effect. The DPS 1205 is a yellow 8½x11 form.

Here's the what the criminal sentence for a first time DUI over .08:

A fine of $300 to $1000 plus surcharges for the DUI, and possibly an additional fine for the underlying traffic charge.

A minimum jail term of ten days to 12 months. That can be suspended except for a 24 hour period. The time he spent in jail can count towards that 24 hours.

40 Hours community service.

Completion of a DUI Alcohol or Drug Use Risk Reduction Program approved by the Department of Driver Services.

12 months probation

There could also be a license suspension imposed by the criminal court.

If they want to be really rought, they could go up to 12 months imprisonment and $1000 fine plus surcharges for both offenses, but no one carries it that far. The big thing is to comply with the terms of the probation.
