I WAS RECENTLY INVOLED IN AN ACCIDENT. I WAS RAN OFF OF THE ROAD BY ANOTHER VEHICLE, AND TOTALED MY CAR. THE OTHER CAR NEVER STOPPED. HOWEVER, THE HIGHWAY PATROL GOT TO THE ACCIDENT AND SENT ME TO THE HOSPITAL.
WHILE AT THE HOSPITAL THE TROOPER ASKED ME TO TAKE A BREATH TEST AND I DID. I BLEW .077 THE LEGAL LIMIT IS .10.
HE TOLD ME THAT I WAS WELL UNDER THE LEGAL LIMIT AND HE WAS NOT GOING TO SITE ME FOR DUI.
THE FOLLOWING DAY THE TROOPER SHOWED UP AT MY HOME AND TOLD ME THAT HE WENT TO THE HOSPITAL AND ASKED FOR MY BLOOD TEST RESULTS,AND IT WAS .155 BAC. HE SITED ME FOR DUI.
MY QUESTION IS, HOW CAN HE RECIEVE THAT INFORMATION FROM THE HOSPITAL WITHOUT MY CONCENT OR A SAPINA? ALSO HE DID NOT REQUEST THAT I TAKE A BLOOD TEST THE HOSPITAL DID THAT AS PART OF THE PROCEDURE.
ALSO, IS THERE ANY WAY I CAN SUPPRESS THE BLOOD TEST RESULTS?
