What is the name of your state (only U.S. law)? PA and OH

I received a dui last week in PA (where my license is from) and then got arrested in OH for a dui last night. How does this work?

Will i get a 1st offense and a 2nd offense? or 1st offense in each state?

They probably won't know about each other since both are so recent. That may change as both cases proceed.

I don't mean to lecture you, but do us all a favor, and stay off the road. You obviously have a drinking problem. Either give up driving or give up drinking. Get some help.

As a general rule, if you pass the field sobriety test, you don't get arrested.

Just because YOU feel that you passed the test doesn't mean that you did.

I will say that getting two DUI's within a week does not bode well for you.

Everybody thinks they passed the FST.

Fortunately the two arrests occurred before going to court for either one. I'm pretty sure both will count this as two first time DUI's. ARD (provided you haven't had issues in the past) is possible in Pennsylvania. Contrary to others here, I'd recommend lawyers in both states.

The real downside is that while PA normally looks the other way on first time out of state DUIs for administrative suspensions, they probably won't this time.

Each time they pulled me over for no good reason. I passed the field sobriety test both times.
cops can and do go on fishing exepeditions for DWIs
ie: Dwi saturation patrol, overtime grant, some just see it
as thier mission

99% of the time it does not matter how you did on the FST
you are going to blow anyway

remember one thing, you did not get a DWI because you got
pulled over for no reason you got it because you had been
drinking

when your lawyer get the discovery it will most likely read like:
as i approached the vehicle i noticed a stong odor of alcohol.
and descriptions like slurred speech and bloodshot eyes.

see I think PA is going to catch this. They will do another background check before ARD is granted by then the arrest will show up from Ohio and thje poster is going to have some issues not exactly sure what they will be.

what county in PA? Mercer lawernce Butler?

I agree with PAGUY...They will catch the OH DUI when they do the background check for ARD. This is an interesting case and a first that I am seeing. I think you would be eligible for ARD, but then lose your license for a year for an out of state DUI. The reason I say this is because I did something similar, but it was about 8 years apart. But for sake of argument, it could have been 8 days apart because of PA's 10 year lookback. I got a first in PA in 2000 and rec'd ARD. I got a second in NJ in 2008. It was treated as a second in PA and a first in NJ. It wasn't a true 2nd in PA, but they suspended my license for a year and req'd me to sign up for the interlocking device....I didnt have to do that because I chose to transfer my vehicle to a sibling and take public transit to work (1.5 miles).

Life is good right now. And any time I drink, I don't have to worry about hurting someone. I highly suggest people with 1+ DUI look into their local transit system. Go green, save green, save lives.
