DUI out of state future driving privileges

Alright so this may be an odd one and it's for future reference, as I know I can't get my license back right now.

I am a resident of Florida and was visiting Illinois where I'm from. I got in a single vehicle accident with no passangers, got a lawyer, and ended up pleading guilty subject to fines and a license revocation of at least 1 year from Illinois, along with probation for 1 year. I know my Florida DL will be revoked after it goes through the state of Illinois and they forward it to Florida.

My question is if I am looking to get a restricted driving permit, or in the future my license fully restored, may I go through the FL DMV (since they're in the interstate pact and it was a FL license) or do I have to go through Illinois (and their laws) to get it back, since it happened there?

I disagree.

While the OP will eventually have to take action in Illinois if he ever wants to legally drive there again, it is Florida that issues his license and will be the state that has to decide whether or not the OP will be issued some type of restricted license.

To clarify, Illinois would get involved with a restricted privilege if the OP wants to drive in THAT state during the revocation period.

And I disagree with you. I stand by what I said earlier.

The state that took action against the license was Illinois and Illinois needs to allow for a restricted license, not Florida.

Not sure what Nevada has to do with this.

Every state has different rules regarding "restricted" licenses as well as different penalties for DUI/DWI, etc. Illinois can only control what happens in Illinois. Yes, they can report the conviction to Florida but that doesn't even mean that Florida must take the same license action as Illinois does. Florida would take action based upon Florida law.

When Illinois revokes someone's driving privilege it only affects driving in Illinois. For instance, until Florida takes license action against the OP he can drive in Florida and any other state except for Illinois. If Florida takes license action against him (i.e. suspension or revocation) it would be in accordance with Florida law and DMV rules, and if he wishes to get a restricted (i.e. hardship) privilege he would have to deal with that locally in Florida.

He would have to deal with Illinois only if he wishes to drive in Illinois during the Illinois revocation period. Of course, if his Florida license is currently suspended/revoked then he can't drive in Illinois even if granted a restricted or hardship privilege there.

After working overnight and getting two hours sleep today maybe I'm missing something or maybe I'm just not explaining myself well enough.

I take it you did not read the information in the links I provided. It was not strictly Nevada-specific.

Read the information on Illinois and Florida and what applies to the (majority) of states that belong to the Driver's License Compact and/or the Non-Resident Violators Compact when it comes to revoked and suspended licenses.

I still stand by my original answer.

"No state may issue a driver license if there is an active suspension or revocation in another state."

If you cannot be issued a driver license, you cannot get the license restricted.

You must follow Illinois' process for reinstatement before you can get a license in Florida.

It would probably be easiest if Longsun simply called his local Florida DMV to ask about getting a restricted or hardship license in Florida when his driving privileges are revoked in Illinois (and more than likely his license already revoked in Florida). :)

License has not been revoked yet in Florida ( I checked the FL DMV website today), as it was VERY recent all this happened. 2 months ago was the incident however the plea and probation just started 2 weeks ago. I know I'm being very premature on thus but just wanted to get an idea. It probably takes a few weeks before Florida will get word of revoking my license knowing how slow the IL government works.
