If you are in the military and are pulled over off post and given a dui but are not yet convicted, can the military still punish you for the same crime even though the state is going to anyway??? Wouldn't that be considered DOUBLE JEOPARDY????

Double jeopardy occurs when the same government system tries or punishes you twice for the same crime. However, you are under the jurisdiction of the state courts, the federal courts, and the military courts.

So, a member of the military who kidnaps someone and transports them across a state line has violated state, federal, and UCMJ laws and can be tried and punished by all 3 court systems.

Clear as mud now? :)
