DUI while not DUI but on probation

Osceola County, Florida... My father was recently arrested for a supposed dui. I know for a fact he hadnt been drinking but he was already on probation due to past events that he deserved to be in jail for. Since he was released he has turned his life around for the most part. He still hangs out with some people he shouldnt but stays out of trouble. He was given 6 sobriety tests and passed them all but after when he refused the breathalyser test he was arrested. He took the test when he arrived at the jail and it showed he hadnt been drinking. The arresting officer thought my father had been drinking due to slight swerving while driving when in fact he was only trying to unwrap his sandwich he just bought right before the traffic stop. Also my father slurs his speech slightly due to his dental plate is sometime loose. Is there anything that can be done in this case? He wasnt even able to be bonded out due to him being on probation and we're being told he has to get a lawyer.

Your father needs an attorney, a refusal to blow could cause his probation to be revoked. Also, you post just beat the deadline for the lamest excuse of the year award and it had 2 of them.

Have you actually seen the results of the breath test yourself or are you just taking his word for it? Addicts lie a lot.
