What is the name of your state (only U.S. law)? Texas


I have couple questions. My lawyer and i are discussing going to trial. He has said it might be good but not sure. I was offered 5 years TDJC. And was also told that it is quarter time and would get good time and work credit also. I just do not know what all of this means. How long would you actually stay for 5 years? And they said they would get me in rehab in there. This is what i been asking for over a year and the money is too much outside prison though.

other question is i just want it over, IM scared and no its my fault. But lawyer said he could get the court case expedited if we go that route. An someone said this could take only a weeek but i dont see how this could be that quick. My court is wednesday to accept the plea or take bench or jury trial.

Lost and not sure what to do.Thanks in advance

There is no way to know how much time you will actually serve on any sentence. All that is certain is that your actual time served plus your good conduct time must add up to 1/4th of your sentence (for this type of charge) to come up for parole. Your conduct in prison will of course determine how much good conduct time your earn, and will also be a factor in considering you for release.

Different units have different rehabilitation programs, you just have to sign up for them.

Not sure what you mean when you say you don't see how this can be expedited, or a quick process. If you want to set the case for a plea then you can do it just about any time the court can schedule it. You plea and check into jail that day for transfer to TDCJ.

If you opt for trial then it is just a matter of when it gets reached for trial, but the trial itself shouldn't take more than a day or two for a felony DWI.

No one here can tell you whether to accept that plea bargain or not. We know nothing about your case, your criminal history, or the demographics of your county and/or judge.

I am not familiar with TDCJ, but i assume it's jail. I would say do not count on good time or working time. Whatever sentence you receive take at face value as many unexpected situations sometimes arise in jail. Than if you get out before that date it's a good day.goodluck.

Thanks for your response, but what i meant was if I decide on trial, i want to get it expedited as the lawyer said he could expedite it for me to speed up the date of the trial. I just didnt know how long it would take even if they expedited it. I heard a week but even that seems like it would not be enough time. And yes, Im not asking advice on accepting the plea bargain as I already know my options on all of this.

No its a prison. And yes, good time and work time is available as well as the quarter time(whatever the heck that means).

but I think the first poster explained it fairly well
