I need a legal definition of a dwelling. I built a cute little storage building -- no water, no sanitary, not weathered in, etc -- and my homeowner's association is trying to claim it is a dwelling and subject to size restrictions because I spend the night there occasionally. It is a rural lot.

Any help?

What do the homeowner's rules say. I think that they can define a dwelling for there purposes. If they say anyplace where a person can stay the night, then that is a dwelling for the homeowner's association purposes.
