What is the name of your state?VA
my friend just called me and is in jail. she was in an accident(she said she bumped somebody) and blew a .18, i think she took 2 breath tests. they wont let her out for a couple of hours. she has a clean driving record, this is just a bad mistake. does anyone know what VA usually does to first time dwi? i want to be able to tell her something when i pick her up. i wish she hadnt taken the tests but no use worrying now. thank you if anyone can help

She should expect a minimun suspension period of 7 days to a year, with no driving priviledges during suspension. Also fines up to $2500 plus penalty assessments. Considering she blew a .18 (the legal limit is .08) AND she got into an accident she should expect the strictest sentence.
 
first of all I would not try to explian anything to her if she is .18. That is counterproductive...as I am sure you know. wait until she is not intoxicated and able to comprehend your comments. Not advice For what it's worth. Patrolman/J. Buckner

In addition to what the other posters said, she should also expect insurance rates in an amount of what her car costs. Also, perhaps an interlock.

That is, if she is not in jail and does not have her license jerked.

Virginia just upped the ante in the DUI arena. In July the VA general assembly increased the penalties as far as DUI's are concerned.

If she is convicted of a DUI with a BAC of .18 she will recieve a mandatory minimum (the judge has to assess at least this punishment but could go with more) of 5 days in jail and a mandatory minimum of a $250 fine. The officer will have administratively suspended her license for 7 days from the arrest. She will have a suspended license for 1 year from the date of conviction. She will also be required to complete an alcohol and substance abuse prevention program. A conviction of 18.2-266 is a class 1 misdemeanor. All that means is that there is a possibility of up to 12 months in jail and a $2500 fine.
