What is the name of your state? New Jersey
Exhusband and I share joint custody and my sons were living with him. On July21,2005 one of my sons was hit by someone who lived with my exhusband. We went to the police and they contacted DYFS. 2 of my three sons were sent home with me. In September 2005, my other son came to live with me. SInce then, a judge has granted me temporary residential custody and exhusbands visitation was suspended. I do not want any assistance from DYFS and I have told them this countless times. They have questioned and searched my sons at school over two months after my sons were placed with me. I was never asked if this was okay. This case was supposed to be closed twice already, but there is always a lame excuse. They came out to close it and then told me when they got here that it is going to remain open because my exhusband wants their services now(almost a year later). This matter is before the courts and DYFS attorney stated that they completed the investigation and they will not be litigating the matter. Why are they still knocking at my door and calling me? This has got to stop and I need guidance(legal) as to how to stop their visits.What is the name of your state?

You may ultimately need an Attorney to represent YOU ..

It sounds like your X now wants to follow Child Protectives recommendation to be able to regain visits eventually , maybe even supervised if he starts following a plan .

As long as they are involved they will want to stay involved , especially since a lot of cases get closed , and drastic things happen sometimes and ultimately it would come back on the Agency and workers .

Why would they want you to have services ?

The bottom line is they have to have the kids best interest in mind , and these things take time .

Could be the X is making new allegations , they want to follow up on too.

there were never any allegations against me. My ex had supervised visitation and messed up every visit. I wrote everything down and took it to my lawyer. We had another hearing where his visitation was suspended. The attorney general and deputy attorney general sent papers to my lawyer stating that they completed their investigation and will not be litigating the case, yet they are still wanting to do monthly visits. I contacted the child advoctae office and they told me to contact my lawyer. I did. He wants me to just bite my tongue and continue these visits, because if I don't they will come back angry and bite me in the butt. I want to take them to court, but cannot afford it. As far as their services, they want me to go through them to put my sons in counseling. I had them in counseling when all of this first started in July 2005. After the visits stopped, I saw a big difference in my sons. They were so much happier and were not scared. My sons have been on the honor roll with high honors every marking period throughout the school year. What more do they need to see? My sons are adjusting quite well. They have told the workers this. There has been so much that DYFS has done wrong. Even telling my son that he was lying. Trying to put words in their mouths...trying to get them to say that they do not like it here. It is just wrong!

You should have continued your sons' therapies until the therapist recommended cessation , and made a discharge . The Agency may still believe the children have issues . What was noted in their discharge(s) ?

I'm afraid your Lawyer is correct , so just keep doing what you're doing keep school records , etc .

If it's only once per month bide your time .

I agree that you should listen to your lawyer. You really don't want to mess around with DYFS.

DYFS backed off!

I decided to go with my gut feeling on this and threatened DYFS with a lawsuit violating many of our rights. I spoke to many state officials and made it known that I was ready to go public...media attention! Miraculously, they backed off telling me local management gave them the okay to close the case. LMAO yeah right! I bet they did. Just like my exhusband was receiving their services...NOT! Thanks for the help!

When you obtain an Official Notice , let us know .

If all goes well , then Congrats . Cases I've seen take up to 6 - 12 months to close .
