What is the name of your state? TX

I am a British Citizen on an E-1 visa. My wife is also on the E visa. However 12 months ago we seperated and I returned to the UK. She still lives in the USA on my E-1 visa. She signed a declaration to teh US department of State saying she would return to the UK when my work ended, which it has and thats why I am back.

She still resides in Texas. Is she allowed to be in the USA

If you are technically still legally married, then she is still entitled to the dependent visa status but practically speaking, there is really not much she can do with it because at some point it will run out and she will not have a means to extend it unless she obtains her own visa in her own right.
