What is the name of your state? Louisiana, without personal comments or opinons, I am intersted in retailing glass pipes online, I have seen a number of other sites including popular auction sites engaging in this activity, Is it legal? If not could you please supply me with statue codes. Thanks

need factual direct answers

Some Random Guy said:
For the most part, its not a matter of statute codes for tobacco products. Its whether any DA in any county in the US will consider that these pipes are for non-tobacco use.

How can any DA prove what the glass pipes are being purshased for? And if the use of the pipe was proven to be illegal wouldn't the blame and offense be directed to the buyer. What I really need to know is there is a law prohibiting the sales of glass pipes online. please help

no there is not

However it would be a good idea to add a disclaimer to your site stating they are for tobacco use only. If it was illegal there would not be so many sites selling them. Currently if you do a search for glass pipes you will get over 5 million hits.

Here is one of the disclaimer I got off of one site:

* I am 18 years of age or older

* Tobacco products/glass pipes are sold legally in my state/country

* I agree to use the products offered herein for legal purposes only

* I am not entering this site with the intention of gathering information in order to prosecute the owners of kindglass.com.

It won't take very many calls to your Attorney General's office for them to come after you. Why do you think people demanded and got stiffer laws and limitations on those bas-tard telemarketers?!

Google "Tommy Chong's Pipes". He was selling supposedly tobacco only pipes but was busted and spent a year in jail. It is a known fact glass pipes are lousy for smoking tobacco and most law enforcement and district attornies know this.

One thing of note about Chong's trouble

When Tommy Chong and a group of other manufacturers and/or distributors were targeted by the government, there was something that set them apart from other pipe makers. They all also marketed urine cleansing formulas, which aren't illegal, but the government doesn't like them, so they used the paraphenalia to shut them down. What is really terrible is that I had a Chong glass pipe I bought at one of his shows a month or 2 before his arrest, but it was taken as evidence by police in a case that was thrown out for illegal search.

Just sell 'em as collectibles with a removable plastic plug in the throat just in case someone wanted to "experiment".
