AZ, but the trust was made in Iowa.

My siblings, cousins and I are the secondary benificiaries of a trust.

The first beneficiaries were my uncle's siblings and his wife, my aunt.

The trust was created by an uncle that passed away 18 years ago.

At present, there are his wife and one sibling still alive, both of whom are in their lower 90's. Both of them are very well off and don't need the monthly checks they are receiving from the trust.

When the trust was created, my uncle wanted his siblings and nieces and nephews to benefit. Now, some of the nieces and nephews are approaching 70 and some could use the money from the trust to help them in the older age. And we feel some possibly could pass away before his wife and sibling.

But here is the problem. My uncle's wife, whom he married at an old age, won't agree to an early distribution of the trust. She is very controlling and stubborn and has been asked if she would and refused.

Is there any way that the trust can be terminated without her agreement? Oh, and and by the way, the uncle's sibling has agreed to an early distribution.

Any ideas?

Thanks
Smitty

It is quite rude and unreasonable to be asking this--the trustee must administer the trust specifically according to its instructions as the trustee is carrying out the wishes of the decedent. Whether or not the designated beneficiaries truly need the money or not is immaterial--they can do whatever they want with the monies they are legally entitled to.
